Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Shutterstyle (“Shutterstyle,” “we,” “us”). They cover your use of useshutterstyle.com and the related apps, features, and services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. Questions? Email founders@useshutterstyle.com.

1. What Shutterstyle is

Shutterstyle is a tool for professional photographers — primarily family, lifestyle, portrait, and maternity photographers — to plan and share wardrobe guides for their client sessions. You build “style guides” from a curated catalog of clothing products and your own wardrobe library, and you share them with your clients via a link.

The Service is offered with a free trial and paid subscription plans. Pricing, plan limits, and feature availability may change; we'll give reasonable notice of material changes that affect you.

2. Accounts and eligibility

  • You must be at least 18 years old to create an account.
  • You must provide accurate information at sign-up and keep it up to date.
  • You're responsible for your account and for everything that happens under it. Keep your password safe and tell us promptly if you suspect unauthorized access.
  • One person per account. Don't share login credentials with others, including other photographers on your team — they should have their own accounts.
  • We may suspend or close accounts that violate these Terms or that we reasonably believe are being used to harm the Service, other users, or third parties.

3. Your content and what we may do with it

You retain ownership of the content you put into Shutterstyle — your style guides, the names and notes you write, the closet photos you upload, your business profile, and your logo (your “Content”).

License to operate the Service

To run the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, and display your Content as needed to provide, secure, and improve the Service — for example, to render your style guide to a client you share it with, to generate previews and OG images, and to back up your data.

Marketing reuse of sanitized style guides

You also grant us a worldwide, non-exclusive, royalty-free, perpetual, sublicensable license to use, reproduce, modify, and display sanitizedversions of your style guides — including the palette, the products you selected, the role labels (such as “Mom” or “Big Sister”), and the overall composition — across Shutterstyle's own marketing channels (including but not limited to Pinterest, Instagram, our blog, paid advertising, and partner placements).

“Sanitized” means: before any external use, we remove identifying client information — client and family names, session dates and locations that could identify a family, free- text notes about a specific client, and the guide's URL slug if it could identify a client. We do not republish photos from a client session; the marketing reuse covers the curation artifact (palette + products + role labels), not photographs of the people being styled. We may include attribution to your business when we feature a guide, and we may omit attribution for layout reasons; either is permitted under this license.

If you delete a style guide or close your account, we'll stop creating new marketing material from that guide, but any material already published externally (for example, an existing Pin on Pinterest) may remain in place — those platforms are outside our control. We'll make reasonable efforts to remove a specific published item on request.

You're responsible for what you upload

You represent that you have the rights to the Content you put into Shutterstyle — including any closet photos, logos, and business assets — and that your use of the Service does not violate any contract you have with your clients, models, or other third parties. You're responsible for getting any consents your clients require, and for following the laws that apply to your photography business.

4. Catalog products and merchant links

The product catalog inside Shutterstyle is curated and includes items sourced from third-party retailers. We may earn an affiliate commission when a client purchases a product through a link in a style guide. We don't sell the products ourselves, we don't hold inventory, and we can't guarantee that any product will remain in stock, available, or priced as shown. The retailer's terms apply to any purchase.

5. Acceptable use

You agree not to:

  • Use the Service to upload, store, or share content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that depicts minors in a sexualized way.
  • Upload content that infringes anyone's copyright, trademark, privacy, publicity, or other rights.
  • Reverse engineer, scrape, or attempt to extract the catalog, palette data, or other Shutterstyle-owned content for use outside the Service.
  • Use the Service to build a competing product or train a machine learning model.
  • Probe, attack, or interfere with the Service's infrastructure, rate limits, or security controls.
  • Resell, sublicense, or commercially redistribute the Service or any non-public parts of it.
  • Impersonate another person, including another photographer or business, or misrepresent your affiliation with one.

6. Subscriptions, trials, and billing

  • New accounts start with a free trial of paid features. After the trial, continued use of paid features requires an active subscription.
  • Subscriptions are billed in advance by our payment processor (Polar) on a monthly or annual cadence, and they renew automatically until you cancel. You can cancel anytime from your settings.
  • Fees are non-refundable except where required by law. If you cancel mid-period, you keep paid access until the end of the period you've already paid for.
  • We may change prices for future billing periods. If we do, we'll give you reasonable advance notice and an opportunity to cancel before the new price takes effect.
  • Referral rewards (renewal-day credits) are governed by the rules described in-app; we may adjust them or end the referral program in the future with reasonable notice.

7. Termination

You can stop using the Service and delete your account at any time from your settings. We can suspend or terminate your access if you breach these Terms, if your use creates a legal or security risk for us or others, or if we discontinue the Service. We'll give you reasonable notice where we can, except in cases involving security, legal compliance, or abuse.

When your account is closed, we delete or anonymize your personal data as described in the Privacy Policy. The marketing-reuse license in Section 3 survives termination for material we've already created or published.

8. Our intellectual property

Shutterstyle, the Shutterstyle logo, the product catalog, the curated palettes, the underlying software, and the way the Service looks and feels are owned by us or our licensors. These Terms don't grant you any right to our trademarks, brand elements, or non-public content beyond using the Service for its intended purpose.

9. Third-party services

The Service integrates with third-party services (for example, Google for sign-in, Polar for payments, Pinterest for sharing, and product retailers for purchase). Those services have their own terms and privacy policies, and we're not responsible for them. If a third-party service goes down or changes, parts of the Service may stop working — we'll do our best to keep things running but can't guarantee uptime of third-party systems.

10. Disclaimers

The Service is provided “as is” and “as available.” We don't warrant that it will be uninterrupted, error-free, secure against every threat, or suited to a particular purpose. Style guides, product recommendations, and palette suggestions are tools to help your creative work — they're not professional, legal, or business advice, and outcomes depend on factors outside our control.

To the maximum extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent allowed by law, Shutterstyle and its owners, employees, and contractors won't be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to the Service — even if we've been advised of the possibility.

Our total liability to you for all claims related to the Service is limited to the greater of (a) the amount you paid Shutterstyle in the 12 months before the event giving rise to the claim, or (b) one hundred US dollars ($100). Some jurisdictions don't allow these limits; in those places, our liability is limited to the smallest amount permitted.

12. Indemnification

You agree to defend, indemnify, and hold harmless Shutterstyle from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your Content, your use of the Service, your business activities, or your breach of these Terms.

13. Changes to these Terms

We'll update these Terms when our practices change. When we make a material change we'll update the “Last updated” date at the top and, where appropriate, notify you by email or in the app before the change takes effect. Continued use of the Service after a change means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Arkansas, USA, without regard to conflict-of-laws rules. The state and federal courts located in Arkansas have exclusive jurisdiction over any dispute that isn't resolved informally, except where applicable consumer-protection law gives you a different forum that we can't override.

15. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
  • Severability. If any part of these Terms is unenforceable, the rest stays in effect.
  • No waiver.Our not enforcing a provision doesn't waive our right to do so later.
  • Assignment.You can't assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
